Reply to Attorney Generals Office and for the immediate attention of the Attorney General.
Dear Attorney General
Thank you most sincerely for reply to my recent letter enclosing for your information copy letter sent to Michael Gladney -Collector General, Revenue Commissioners, and I note that as the Law Officer of the State, you are prevented by Article 30 of the constitution from giving legal advice to the citizens. While I accept this explanation wholeheartedly, is it not a fact that under the same Article, it is your bounden duty, inter alia, to “Advise the Government on all the constitutional and legal issues which arise in connection with or at Government meetings. This includes advising whether proposed legislation complies with the provisions of the Irish Constitution, Acts and Treaties of the European Union or other international treaties to which Ireland has acceded. “ (as per Citizens Advice re. Office of Attorney General. ) As we are not seeking advice and we have brought a matter of serious and constitutional importance to your attention, we feel that it is appropriate that you should answer the following questions.
1.......Were you, Maire Whelan, at any time aware of the Madigan and Brennan Supreme Court Judgements, prior to the enactment of the current Household Charge and Residential Property Tax Legislation, and/ or were you asked for , or did you proffer an opinion in relation to same, especially as the Taoiseach, Enda Kenny, while in opposition in 1994, stated, as per the Dail record, that“It is morally unjust and unfair to TAX a persons home, and by so doing, grind him into the ground ; indeed in cases, it could probably be UNCONSTITUTIONAL”
2........ If you were not aware of, or were not asked for an opinion in relation to the aforesaid judgements, and as you have now been made aware of same, will you now consider bringing these serious matters , to the attention of your political masters, in the interest of equity and fair play, and to prevent unnecessary costs to the taxpayers/sovereign people of this country, to whom you are duty bound, by your oath of office, to protect the people from unjust and unconstitutional laws imposed by the executive, without due diligence not having been exercised as required by law.
Thanking you in anticipation of your kind and responsible attention in relation to these serious breaches of the Constitution.
Yours very sincerely,
